Our partner Littler Mendelson Law firm reached out to NAHC and other members of a standing home care coalition to let us know of a new issue that has been raised in the state of Oregon by some of their clients and may or may not be impacting private duty home care agencies.
The Oregon Health Authority issued a memo on January 18, 2021 to home care agencies indicating that home care agencies cannot terminate clients who contract COVID-19 or who are quarantined due to exposure to COVID-19.
Suspending, or terminating services by an agency may trigger a finding of non-compliance with the state and referral to the Oregon Department of Human Services and/or the Oregon State Nursing Board.
The challenge raised by Littler and some of their clients is that many private duty home care agencies cannot safely provide care to COVID-19 positive patients or those quarantining for exposure as they may lack a respiratory program.
